BizWin 대표 박요셉(변호사)은 2026. 2. 5. 인천 미추홀구 인천지방변호사회관에서 인천지방변호사회 및 베트남 동나이지방변호사회의 공동 주최로 개최된 학술대회에 참석하였습니다.

박요셉은 본 학술대회에서 검찰청의 공소청화를 중심으로 한국의 형사사법제도를 소개하였습니다. 특히 박요셉은 로마법부터 나폴레옹 형사소송법, 조선의 경국대전 및 리 왕조(Lê) 의 국조형률{Quốc triều hình luật, 홍덕법전(洪德法典)}, 영미법과 프랑스법 및 일본법을 비교하고, 검사와 판사 사이 영장발부권한의 분배 등 현대적 형사법적 장치들이 어떤 정치적 배경하에서 입법에 이르렀는지, 한국의 자본주의국가로의 특징과 베트남의 사회주의국가로서의 특징을 대비하여 분석하는 등 양국의 형사사법제도가 달라진 원인을 여러 관점에서 설명하며, 나아가 양국의 법률가들에게 제도적 차이와 공통점에 관한 근본적 이해의 필요성을 강조하였습니다.

박요셉은 현재 인하대학교 베트남법센터의 객원연구원으로 활동중이며, 베트남 변호사회 및 실무가들과의 교류를 통하여 베트남 관련 국제업무의 전문성을 높여가고 있습니다.

Joseph Park J.D. of BizWin participated to the seminar held in the Hall of Incheon Bar Association, Incheon, Korea, at 5th Feb, 2026.

At this conference, Joseph Park introduced the Korean criminal justice system, focusing on the transition of the Prosecutors’ Office into a “Prosecution Service” (an agency primarily focused on public prosecution).

In his analysis, Park compared a vast array of legal traditions, including Roman Law, the Napoleonic Code of Criminal Procedure, the Joseon Dynasty’s Gyeongguk Daejeon, and the Quốc triều hình luật (the Hòng Đức Code) of Vietnam’s Lê Dynasty. He further examined the historical and political contexts behind the legislation of modern criminal justice mechanisms, such as the distribution of warrant-issuing authority between prosecutors and judges.

By contrasting the characteristics of Korea as a capitalist state with Vietnam as a socialist state, he analyzed the divergence of their criminal justice systems from multiple perspectives. Ultimately, he emphasized the necessity for legal professionals in both countries to develop a fundamental understanding of these institutional similarities and differences.

Joseph Park is currently a Visiting Researcher at the Vietnam Law Center of Inha University. He continues to enhance his expertise in Vietnam-related international affairs through active engagement with the Vietnam Bar Federation and legal practitioners.
