BizWin 대표 박요셉(변호사)은 2026. 1. 13. 중국 산둥성(山东省) 웨이하이시(威海市) 소재 잉커로펌 웨이하이사무소(北京市盈科威海律师事务所)에서 인하대학교 창의글로벌대학원 AI · 데이터법학과, 법무법인 로앤에이(Law&A), 산동대학교 법학원, 웨이하이시변호사협회 주최로 개최된 “AI 데이터법 교류학술대회 “에 한국 측 발표자로 참석하였습니다.

위 행사에는 정영진 교수(인하대학교 AI · 데이터법학과 주임교수, 변호사), 이성남 교수(목포대학교), 이상우 교수(인하대학교), 김성호 대표(법무법인 로앤에이, 변호사), 조동선 변호사 등이, 중국 측에서는 유문(刘文) 교수(산동대학교 경영대학원), 장화건(张华建) 변호사(웨이하이시 변호사협회 부회장), 주영호(朱永浩) 변호사(잉커로펌) 등이 각 참석하여 “인공지능 저작물의 보호여부”, ‘지수보험과 AI”, “로봇수집데이터 및 보건데이터 활용” 등에 관하여 발표하였습니다. 특히 양국 사이에서 데이터 주권 및 거버넌스, 개인정보의 국외이전 및 활용, 익명정보의 활용 등에 관하여 격렬한 토론이 이어지며 매우 생산적인 아이디어 형성의 기회가 제공되었습니다. 나아가, 주칭다오 영사관의 류창수 총영사가 축사를 위하여 확회에 직접 참석하여 “인천과 웨이하이가 앞으로도 계속 교류할 수 있을 것”을 강조하였고, 이후 한중 양측은 이번 학술대회를 시작으로 매년 법학교류를 위한 학술대회를 이어가기로 약속하였습니다.

BizWin의 박요셉은 인하대학교 AI · 데이터법학과의 자문변호사이자 같은 대학 중국법연구센터의 특임연구원으로서, 위 세미나의 세션 2, 제3 연사로 참석하여 Cross-border 전자상거래 플랫폼의 확장과 ODR(Online Dispute Resolution – 온라인분쟁해결제도)의 확대 – 특히 AI를 중심으로 한 연구결과를 발표하였습니다. 박요셉은 B2C CBEC를 중심으로 장차 AI를 활용한 ODR의 확대가 불가피하다고 주장하며, 이를 위하여 사전중재합의(Pre-dispute Arbitration Agreement)에 관한 법리 및 판례의 확립, 중국의 소조대접(訴措對接)과 같이 ODR에 강제집행력을 부여할 수 있는 합리적 제도의 개발, 분쟁금액에 따른 차등적 AI 활용 약관 및 그에 대한 충분한 명시 및 설명의무 이행 등, 장차 국가와 플랫폼 기업이 ODR의 적용을 위하여 나아가야 하는 방향에 관한 통찰과 아이디어를 제시하였습니다.

Incheon and Weihai – Did you know they are a “legal” sisters?

Joseph Park, J.D., of BizWin, participated in a seminar dedicated to sharing research on AI and Data Law, held on January 13, 2026, at Yingke(盈科) Law Firm in Weihai, Shandong Province, China. The Korea-China FTA (Article 17.25) officially designates these two cities as Local Economic Cooperation partners. In fact, the distance between them is only about 400km—shorter than the distance from Incheon to Jeju Island or even Busan.

Consequently, it is only natural for legal scholars from these “sister cities” to collaborate and share insights on various legal issues. Although the seminar was titled “AI and Data Law,” presentations also covered taxation, trade, ADR (Alternative Dispute Resolution), and investment. Joseph Park presented his research on ODR (Online Dispute Resolution), noting that China has overtaken most other nations, including Korea, in this field. He strongly urged governments and platform operators to recognize that ODR is no longer optional; in the realm of small-scale B2C Cross-Border E-Commerce (CBEC), AI is destined to play a governing role, and literally could rule over the mankind in certain aspect.

Both Chinese and Korean scholars engaged in rigorous discussion to identify and learn from their legal differences. Echoing the sentiments of the Consul General of the Republic of Korea, Joseph Park emphasized that this conference should not be a one-time event.
