디지털 시대의 공법(公法)과 미래에 관하여 한 · 중 · 일 3국의 법학자들이 모여 논의하였습니다.

BizWin 대표 박요셉(변호사)은 2025. 10. 26. 일본 도쿄도 미나토구 소재 게이오기주쿠대학(慶應義塾大学)에서 인하대학교 창의글로벌대학원 AI · 데이터법학과, 일본 게이오기주쿠대학 법학부, 중국 연변대학교 법학원의 3개국 공동 주체, 일본 게이오기주쿠대학 글로벌연구소(KGRI) 및 일본 존엄성연구센터의 지원에 따라 주최된 “제2회 동북아시아 비교법 연구회” 에 한국 측 발표자로 참석하였습니다.

위 행사에는 정영진 교수(인하대학교 AI · 데이터법학과 주임교수, 변호사), 김성호 대표(법무법인 로앤에이, 변호사), 중국 연변대학교 오동호(呉東鎬, Wú dōng hào) 교수(법학원장), 수군(隋軍, Suí jūn) 교수(심양사범대학교 교수, 국제법치연구원장), 일본 야마모토 타츠히토(山本健人, Kent Yamamoto) 교수(북큐슈시립대학법학부, KGRI 방문교수), 오카다 준타(岡田順太, Junta Okada) 교수(돗쿄대학 법학원), 요코다이도 사토시(横大道聡, Satoshi Yokodaido) 교수(게이오기주쿠대학 법과대학원) 등 한중일 3국의 법학자들이 다수 참여하여 일본의 플랫폼 규제, 동아시아의 데이터 유통, 알고리즘과 사상형성의 자유, 한국의 전자정부와 데이터기반행정, 공공기관의 정보공개와 법적 분쟁 등에 관하여 논의하였습니다.

BizWin의 박요셉은 Cross-border 전자상거래와 법적 쟁점, 특히 디지털세(Digital Taxation)의 도입과 관련하여 DST(Digital Services Tax), IF(Inclusive Framework for BEPS) 및 pillar 1. 2에 대한 각국의 반응 등에 관하여 연구 및 발표하였으며, 이에 관하여 국제조세의 역차별 문제, 향후 국제조세의 형태 및 개정방안 등에 관하여 3국의 법학자들과 토론하였습니다. 박요셉은 토론 과정에서 “pillar 1의 탈(脫) 디지털세화, 미국 트럼프 행정부와 세법개정(One Big Beautiful Bill Act) 등 여러 현황에 비추어 현재 OECD를 중심으로 논의가 활발한 IF가 국제조세의 중심으로 자리잡을 것이라고는 단정할 수 없으며, BEPS(Base Erosion and Profit Shifting)의 문제를 어느 정도 극복한다면 향후 DST의 부활 기타 새로운 국제조세의 질서가 탄생할 가능성 또한 충분히 존재한다.”는 의견을 피력하였습니다.

향후에도 BizWin은 위와 같은 국제적 학술교류에 적극적으로 참여하며 보다 전문성을 높이고, 지역사회 및 국제사회의 법률문화 개선에도 최대한 기여할 계획입니다.

Public Law of Digital Age – how would we comprehend and adapt to it?

Joseph Park, J.D. of BizWin participated to the seminar, “The 2nd Far-east Asian Law Comparison Symposium”, held 26. Oct. 2025 at Keio University, Minato City, Tokyo, Japan. Scholars from Korea, China and Japan gathered together at the seminar and discussed about “Digital age and public law”. The topic was various, such as “Why and how the Japanese government regulate the E-platforms in Japan”, “How the algorithm of google or such big data platforms manipulate human mind”or “How is just Data-based Governing and AI-based Governing different?”.

Two of BizWin’s specialty are tax and international business, hence Joseph Park mixed it up and made a presentation of “Cross-border E-Commerce and Digital Taxation”, in addition, with fluent Japanese. The topic was quite difficult to explain due to the limited time, but the attending scholars fully understood bones and details of the matter and inquired about “Future of DST(Digital Services Tax) – is it already over by IF(Inclusive Framework for BEPS)?” or “Reverse discrimination from taxation of global E-commerce platforms is worried ; Whether just common end users should bear the disadvantages or not?” and such. The discussion went quite hot and Joseph Park answered those inquiries using economical theories(like Dead-weight Loss), also in addition, in Japanese.
